PROJECT COORDINATOR and CLERK OF THE WORKS
REQUEST FOR PROPOSALS

I.  SITUATIONAL ANALYSIS

The Mashpee Wampanoag Tribe (MWT) is undertaking the construction of a new Community Center located at 483 Great Neck Road, Mashpee, Massachusetts 02649.  This facility will be two stories above grade and approximately 44,000 square feet in area. The MWT is soliciting proposals from individuals qualified to serve as “Site Inspector/Clerk of the Works” for this project.  Construction of this project will commence Spring of 2012 and is expected to have a twelve month duration. 

II. GENERAL RESPONSIBILITIES

A. The Clerk of the Works shall be stationed at the construction site and shall be responsible for assisting the MWT with the administration of the Construction Contract. The observations of the Clerk of the Works shall facilitate in providing protection against defects and deficiencies in the Work.

B. The Clerk of the Works shall communicate with the Contractor under the direction of the MWT and the MWT Owner’s Project Manager with their respective full knowledge.  The Clerk of the Works shall not communicate with Subcontractors or material suppliers except with the full knowledge and approval of the MWT and the MWT Owner’s Project Manager.  All changes order must be approved by the MWT prior to implementation.

C. The Clerk of the Works shall be present on site at the discretion of the MWT.  Estimated Average Weekly work hours is 32.  Actual hours worked may vary on a weekly basis during the life of the project.

III. DUTIES and Responsibilities:

The Clerk of the Works shall:

A. Become thoroughly familiar with the Contract Documents. Perform on-site observations of the progress and quality of the construction work as may be reasonably necessary to determine in general if the work is being performed according to specifications and in a manner indicating that the work when completed will be in conformance with the Contract Documents.  Notify the MWT, MWT Owner’s Project Manager, and the Architect of Record immediately if, in the Clerk of the Works opinion, work does not conform to the Contract Documents or requires special inspection or testing.


B. Monitor the Contractor’s daily construction schedules on an ongoing basis and alert the MWT and MWT Owner’s Project Manager to conditions that may lead to delays in completion of Work.

C. Receive and keep current, Contractor requests for information and Architect of Record responses to the Contractor’s requests.

D. Contribute to the review of request for changes by the Contractor. Maintain current record of approved change order and monitor proper construction execution of those change orders.

E. Attend meetings as directed by MWT and MWT Owner’s Project Manager.

F. Observe tests required by the Contract Documents.  Record and report to MWT, MWT Owner’s Project Manager and Architect of Record on test procedures and test results.

G. Maintain records at the Construction Site in an orderly manner.  The records that must be maintained include, but are not limited to the following:

1. Contract Documents
2. Change Orders
3. Construction Change Directive,
4. Reports of Site Meetings
5. Shop Drawings
6. Product Data and similar submittals
7. Requests for payment
8. Relevant information on Contractors, Subcontractor and principal material suppliers.
  9. Daily Construction Reports
  10. Daily record photos of construction progression

H. Maintain a log book of activities at the site, including weather conditions, nature and location of Work being performed, verbal instructions and interpretations given to the Contractor by others, and specific observations.  Record any occurrence of Work that might result in a claim for a change in Contract Sum or Contract Time.  Maintain a list of visitors, their titles and time and purpose of their visit.


I. Assist MWT and MWT Owner’s Project Manager in reviewing Shop Drawings, Timelines, Product Date and Samples.  Notify MWT and MWT Owner’s Project Manager if any portion of the Work requiring Shop Drawings, Product Data or Sample is commenced before such submittals have been approved by Architect of Record.  Receive and log samples required at the Site, notify appropriate parties when they are ready for examination, and record MWT and Architect of Record approval or other action; maintain custody of copies of approved Samples.

J. Observe the Contractor’s record copy of the Drawings, Specifications, addenda, Change Orders and other modifications, at intervals appropriate to the stage of construction and notify the MWT and MWT Owner’s Project Manager of any apparent failure by the Contractor to maintain up-to-date records.

K. Maintain records of Applications for Payment.

L. Review the list of items to be completed or corrected is submitted by the Contractor with a request for issuance of a Certificate of Substantial Completion.  Review the Work.  If the list is accurate, forward it to the MWT, MWT Owner’s Project Manager, and Architect of Record for final disposition; if not, so advise the listed parties and return the list to the Contractor for correction.

M. Assist the MWT and MWT Owner’s Project Manager in conducting inspections to determine the date or dates of Substantial Completion and the date of final completion.

N. Assist the MWT and MWT Owner’s Project Manager in receipt and transmittal of documentation required of the Contractor at completion of Work.

O. Assist the MWT and MWT Owner’s Project Manager in collecting data as mandated by appropriate Federal, State and Local regulations, including but not limited to: The Davis-Bacon Act.

P. Work under the direction of the MWT and MWT Owner’s Project Manager.

Q. Other project related duties as directed by MWT and MWT Owner’s Project Manager.


IV. LIMITATIONS OF AUTHORITY

The Clerk of the Works in acting on behalf of the MWT shall not exceed
Authority as outlined by this agreement.  The Clerk of the Works SHALL NOT:

A. Authorize deviations from the Contract Documents.

B. Approved substitute material or equipment except as authorized in writing by MWT, MWT Owner’s Project Manager, and the Architect of Record.

C. Personally conduct or participate in tests or third party inspections except as authorized by MWT and MWT Owner’s Project Manager.

D. Assume any of the responsibilities of the Contractor’s superintendent or of Subcontractors.

E. Expedite the work for the Contractor.

F. Have control over or charge of or be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the Work.

G. Authorize or suggest that the Owner occupy the Project in whole or in part.

H. Certify an Application for Payment or Issue a Certificate of Substantial Completion.

I. Prepare or certify to the preparation of a record copy of the Drawings, Specification, addenda, Change Orders and other Modifications.

J. Reject Work or require special inspection or testing except as authorized in writing by MWT, MWT Owner’s Project Manager and Architect of Record.

K. Accept, distribute, or transmit submittals made by the Contractor that are not required by the Contract Documents.

L. Order the Contractor to stop the Work or any portion thereof, without written permission of MWT.

M. Approve change orders.

V. GENERAL ADMINISTRATIVE TERMS

A. The Clerk of the Works shall submit invoices on a monthly basis for services rendered the previous billing period.  These invoices shall be submitted to the MWT.

VI. PROPOSAL EVALUATION FACTORS

A. Experience as Site Inspector/Clerk of the Works for Construction Projects during the past five years ranging from $5.0 million - $12.0 million in construction cost.

B. Experience with the Massachusetts Construction Industry

C. Cost of services

D. Personnel availability

VIII. All prospective proposers shall submit the following as part of their response to this Request for Proposal.

A. A detailed resume outlining their experience and qualifications

B. A list of at least three references within the New England construction industry.

C. A statement as to when they are available to commence work on this project.

D. Compensation will be negotiated as part of the procurement process.

E. Native American and/or Tribal affiliations.

A. The Project Coordinator shall be stationed at the construction site and shall be responsible for assisting the Clerk of the Works in facilitating the correct execution of the Contract Documents.

B. Provide an on-site liaison between the MWT and the Owner’s Project Manager and the Contractor.

C. The project coordinator shall be present on site at the discretion of the MWT.  Estimated Average Weekly work hours is approximately 24.  Actual hours worked may vary on a weekly basis during the life of the project.

III. DUTIES and Responsibilities:

The Project Coordinator shall:

A. Become thoroughly familiar with the Contract Documents and perform the duties of the Clerk of the Works while the Clerk of the Works is not on Site. While site presents overlap, the Project Coordinator will shadow the Clerk of the Works and assist as required in reporting and observing.

B. Present monthly updates to the Building Committee on the Community Center’s construction progress.

C. Be tribal liaison for the Design and Construction teams.
  During meetings, express The Tribe’s point of view and member concerns with relation to construction. 

D. While on site the Project Coordinator will coordinate Tribe member visitations.

E. Attend meetings as directed by MWT and MWT Owner’s Project Manager.


F. Assist the Clerk of the Works in observing tests required by the Contract Documents.  Record and report to MWT, MWT Owner’s Project Manager and Architect of Record on test procedures and test results as required.

G. Assist the Clerk of the Works, MWT, and MWT Owner’s Project Manager in receipt and transmittal of documentation required of the Contractor at completion of Work when required.

H. Work under the direction of the MWT and MWT Owner’s Project Manager.

I. Other project related duties as directed by MWT and MWT Owner’s Project Manager.

The WIA department is currently accepting new client applications for enrollment in certificate programs at Cape Cod Community College. There are 9 slots available.

In addition, the WIA department is accepting client applications for training in Municipal Wastewater Treatment Plant Operations. There are three slots available and interested candidates should apply by December 15, 2011.
